CHICAGO (WLS) -- In what could be a test of a new patent rules in the U.S., Uber is looking to patent its surge pricing application.

Uber has been frequently criticized for their surge pricing, which works by charging more when demand is higher. A ride during surge pricing can cost hundreds of dollars.

Uber originally tried to patent the technology in 2013, but their application was rejected. New guidelines from the U.S. Patent Office now try to seek more of a balance between promoting free commerce and rewarding innovators.
